Welcome to Pwnch, a decentralized, privacy-first encrypted social networking and messaging platform. By accessing or using Pwnch, you agree to the following Terms of Service (“Terms”). Please read them carefully.

These Terms govern your use of Pwnch, including all content, messaging features, communities, groups, marketplace tools, and any other services we provide.

1. Acceptance of Terms

By using Pwnch, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, do not use the platform.

Because Pwnch is anonymous and decentralized, you are responsible for your own actions and for ensuring your use complies with all applicable laws.

2. Eligibility

You must be at least 13 years old to use Pwnch.
If you are under 18, you must have permission from a parent or guardian.

We do not knowingly collect personal information from minors.

3. Privacy & Anonymity

Pwnch is designed to collect as little information as possible.
We do not require real names, phone numbers, emails, or identity documents.

Your use of the platform is also governed by our Privacy Policy, which explains what we do and do not collect and how decentralized data flows through the network.

4. User Responsibilities

Because Pwnch is decentralized and anonymous, you are fully responsible for your actions.
By using the platform, you agree not to:

• Break any local, national, or international laws

• Harass, threaten, or harm others

• Post content involving child exploitation or other illegal material

• Engage in fraud, impersonation, or scams

• Use the platform to distribute malware or conduct attacks

• Violate intellectual property rights

• Interfere with network functionality

You agree that your use is at your own risk and that no platform operator, node host, or contributor is responsible for your behavior.

5. Content Ownership

You retain full ownership of the content you create.
Because Pwnch is decentralized:

• We do not control or moderate all content

• We do not centrally store your data

• Content may be replicated across the network

• Deleting content removes it from your device and any nodes that respect deletion, but decentralized systems may preserve remnants beyond our control

By posting content, you grant Pwnch a non-exclusive, royalty-free license to display it within the decentralized ecosystem as intended by the platform’s design.

6. End-to-End Encrypted Messaging

Pwnch provides encrypted messaging, meaning your messages cannot be read by us or third parties.
However, you understand and accept that:

• Device security is your responsibility

• Lost keys may result in lost access to messages

• No encryption system is 100% invulnerable

• Decentralized networks may not guarantee message retention or delivery

7. Groups, Communities & Marketplace

Pwnch allows users to create communities, groups, and marketplace listings.
You acknowledge that:

• Community admins may set their own rules

• Marketplace transactions occur at your own risk

• Pwnch does not mediate disputes

• Pwnch does not guarantee the accuracy, safety, or legality of community or marketplace activity

Marketplace interactions may involve third-party payment systems, each governed by their own terms.

8. Prohibited Content

You may not use Pwnch to create, share, or distribute:

• Child sexual abuse material

• Terrorism-related propaganda

• Explicit threats of violence

• Malware, spyware, or harmful code

• Doxxing or private information of others

• Any content illegal in your jurisdiction

We reserve the right to restrict access, block content, or limit platform usage for severe violations—even within a decentralized environment.

9. Decentralization & Availability

Pwnch is a decentralized network, which means:

• We do not control all servers or nodes

• The platform may experience outages or inconsistencies

• Your data is not centrally backed up

• We cannot guarantee 100% availability or continuous service

You agree that Pwnch is provided “as-is” and “as-available.”

10. No Warranty

Pwnch is a decentralized experimental platform.
We provide no warranties of any kind, including:

• No guarantee of uptime

• No guarantee of error-free operation

• No guarantee of uninterrupted communication

• No guarantee of data permanence or deletion

• No guarantee of anonymity if you voluntarily reveal information

You use Pwnch entirely at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Pwnch, its developers, contributors, node operators, partners, and affiliates are not liable for:

• Damages arising from your use or inability to use the platform

• Loss of data, privacy, or content

• Financial losses, scams, or marketplace disputes

• Actions taken by other users or third parties

• Security breaches outside our reasonable control

Your sole remedy for dissatisfaction with the platform is to discontinue use.

12. Changes to the Terms

We may update these Terms from time to time.
If major changes are made, we will notify users within the platform.
Continued use of Pwnch after changes constitutes acceptance of the new Terms.

13. Termination

You may stop using Pwnch at any time.
Because Pwnch is decentralized, deleting your account or keys removes access locally, but does not guarantee removal of all distributed copies of your content.

We may restrict access for severe violations of law or safety.
